Change of Labor Location in Social Service

The fulfillment of the social service is established in Law 116/2015, Labor Code and Decree 326 and the change of work location in resolution 8/2013 of the Ministry of labor and social security. Social service consists of fulfilling the duty of graduates of daytime courses, who attain knowledge at the higher and professional technical level of education, to put them into society's function in accordance with the planning and priorities of economic and social development . Social service lasts for three years and is combined with active military service, so that the sum of both completes the three years and is carried out in the place and work in the entity to which the graduate is assigned.

When it is necessary to transfer a graduate assigned to an organ, body, national entity, senior management organization or other entities for the fulfillment of the social service, to another, it is submitted to the approval of the authorities who assigned him, from the conformity of both organs, agencies, national entities or superior management organizations or other entities.

In cases of internal transfers, approval is submitted to the head of the organ, agency, national entity, senior management organization, or other entities or to whom he delegates, where the graduate was assigned.

Higher Education Graduates

  1. The process of change of work location is requested by the worker based on the written justification of his need to transfer to the entity where he was assigned with an acceptance letter from the requesting body.
  2. If the entity does not agree to grant the release, it notifies the worker within ten (10) business days.
  3. If the entity agrees to grant the release, it notifies its agency which, in turn, will be in charge of notifying the worker, the result of the analysis within a term of ten (10) business days.
  4. The agency evaluates the request and within a term of ten (10) business days notifies the worker of the response and issues the letter of release, to start the process at the Ministry of Labor and Social Security.
  5. The Ministry of Labor and Social Security has a term of ten (10) business days to approve or not, the transfer request. For movements of Higher Level graduates;
  6. The releasing body is responsible for submitting to the Ministry of Labor and Social Security the file consisting of:
  7. Letter of release with the authorized signature of the body to which the graduate was assigned, addressed to the National Director of Employment of the Ministry of Labor and Social Security.

Letter of acceptance with the authorized signature of the body that accepts the graduate, addressed to the National Director of Employment of the Ministry of Labor and Social Security. Graduate Work Placement Report or its copy.

Graduates of Technician of the upper middle level

The letter of request for release from the body is presented to the Provincial Directorate of Labor, with the corresponding justification and the letter of acceptance from the body to which the graduate is being proposed to transfer.

In the case of graduates of Technician of Upper Middle Level who are assigned to the organisms of the Central State Administration or their entities of national subordination, only the release letter can be issued by the provincial Delegate of the organism, for those who have that structure, or the Director of the Company when not. In the case of graduates who are assigned to local subordinate entities (Provincial Administration Council), the Director of the provincial company or of the provincial sector to which they are subordinate may issue the release letter. In all cases, they should be addressed to the Provincial Director of Labor, who is in charge of issuing the authorization for the change, if appropriate.

The release for the change of work location is only effective, from having the entity with the written approval of the Provincial Director of Labor.

Procedures carried out in the municipal branches of INASS:

  • Retirement or pension application.
  • Request for review in case of disagreement with the calculation of the pension.
  • Restitution of the checkbook at the expiration of the previous one.
  • Restitution of the right to a pension upon cessation of the cause that originated its suspension.
  • Solution for the collection of retirement or pension when the loss or deterioration of the means of payment occurs (checkbook).
  • I authorize to collect the benefit due to the temporary departure from the country of the pensioner.
  • Request to transfer the collection center.
  • Issuance of data certification to the pensioner, with a view to their return to employment.

About retirement or pension application

The ordinary pension by age is granted to the worker who is 65 years of age or older and to the worker who is 60 years of age or older, in both cases must prove at least 30 years of service.

The total disability pension corresponds when the worker is judged, by the commission of labor medical expertise, her total incapacity to work, in addition to the worker being totally incapacitated for work, being linked to work.

The administrations of the labor entities are in charge of compiling the pension file by age, total disability or by the death of a worker and to present it to the corresponding INASS subsidiary for processing.

Pension applications from people protected by special social security regimes will be dealt with, and officials of the institutions or entities that represent them will be entrusted to them. In the event of the death of a retiree or pensioner, the relative must appear at the INASS subsidiary of their municipality of residence to carry out the corresponding procedures.

Are you interested in starting as a Self-Employed Worker?

The person interested in self-employment, submits the following documents to the designated official of the entities that issues the authorization, in order to decide whether the request is appropriate or not:

  1. Request brief
  2. I.D
  3. Two 1x1 photos
  4. Application for authorization to employ contracted workers and draft employment contract or equivalent document, where the clauses and agreed conditions are specified;
  5. Authorization of the Historian or Conservator, as appropriate, in the cases in which he intends to carry out the activity within the limits of the Priority Conservation Area; and
  6. Other documents required by the entity that issues the authorization, in correspondence with the activity to be carried out.

What is the content of the documents you must submit?

  1. Description of the activity you intend to carry out and the place where you will carry it out;
  2. Sworn declaration of the origin of the financing source and the investments made or to be carried out in the activities: Landlord of housing, rooms and spaces; Automotive equipment grease scrubber; Blacksmith; Bodybuilding gym instructor; Recreation equipment operator; Baker- confectioner; Producer selling footwear; Sheet metal service; Building construction, repair and maintenance services; Gastronomic service in cafeteria; Gastronomic service in restaurant; Bar and recreation service; Transportation of cargo and passengers with automotive, rail and maritime means;
  3. Origin of the equipment and means, when appropriate;
  4. Compliance with the rules of Physical Planning, hygiene, food safety, rational use of water, environment and fire protection, when appropriate;
  5. Interest in using posters, artistic services or both;
  6. Production or service schedule, in accordance with the provisions of the People's Power Administration Council; and
  7. Source of origin of the interested party for the purposes of affiliation to social security.

When the request is to carry out activities in dwellings, rooms or spaces, in which acts constituting a crime have been committed on occasion of the exercise of self-employment, the empowered authority does not issue a new authorization.

 As specific functions, the Department of Prevention, Assistance and Social Work must:

    Present for approval the procedures for the development of prevention, assistance and social work, and once approved, guide and control their execution.
    Design the characterization of family nuclei and communities, and guide their execution in the territories.
    Coordinate actions for comprehensive attention to social problems, identify causes and conditions that generate them, and make recommendations to the appropriate bodies, organizations, and other institutions so that, within the framework of their powers and functions, they adopt the appropriate measures.
    Promote and coordinate scientific studies and research for the development of prevention, assistance and social work.
    Present proposals for outreach strategies that correspond to the principles of our society and support prevention, assistance and social work.
    Coordinate and control the education and training of personnel related to these activities.
    Coordinate, control and monitor programs for the care of people with disabilities or others with special needs (care program for children with low weight and height, care for bedridden people, among others).
    Plan resources for prevention, assistance and social work.
    Attend associations of people with disabilities and recommend the pertinent actions.
    Respond, and when appropriate, manage with the agencies, organizations and other institutions the queries and claims of the population.

Structure

The Department of Prevention, Assistance and Social Work has a sub-directorate and two departments: Department of Social Assistance and the Department of Prevention and Social Work.

Departments or areas are organized in the provincial and municipal Directorates of Labor to deal with the activities of Prevention, Assistance and Social Work.

In the municipality to carry out the work of Prevention, Assistance and Social Work, the Social Work Unit was created, subordinate to the Director of Municipal Work and made up of a Chief, a Second Chief and main specialists. The latter combine the care and control of social workers with field work.

Scope

Integration allows achieving comprehensiveness in diagnoses to address the situation of people, family groups and communities, and in solutions to social problems, promoting the participation of all in the prevention and transformation of specific situations and problems, being universal scope.

The Social Work Units have the mission of directing and controlling the work of social workers.


Social workers fulfill the following specific functions:

  • Carry out and keep up-to-date the characterization and social diagnosis of the situation of people, families, groups, communities and institutions in their field of action.
  • Directly and comprehensively serve individuals, families and other social groups that require it.
  • Design, propose, implement and evaluate actions aimed at the prevention and transformation of social problems and the causes that generate them.
  • Promote the participation of individuals, groups and communities in the prevention and transformation of specific situations and problems.
  • Design, propose, coordinate and participate in social transformation projects, oriented to local community development.
  • Participate in the training and research activities required for their professional performance.
  • Processing with the municipal level those cases that, due to their characteristics or size, require it.


For its part, Law No. 105 of December 27, 2008, approved by the National Assembly of People's Power, regulates the Social Assistance regime, establishing protection for the elderly without resources or protection, to any person unfit to work who lacks relatives in a position to provide help, or others who so require, ordering in its article 109, that protection is granted through monetary benefits, species and services.

The need for protection of a family nucleus can be raised by the interested parties themselves, social workers, political, mass and social organizations, institutions, delegates of the constituencies, or another person who considers it so, to the Municipal Labor Directorate, for their attention and evaluation.

The procedures to give effect to the rights of the beneficiaries of the benefits of the Regime, are regulated in Decree No. 283 of April 6, 2009, Regulation of the Law.
